Notification of the protection of the exclusive rights of the brand under the Dunin-Barkovsky trademark
General provisions
This notice reflects the policy of the Dunin-Barkovsky brand, owned by individual entrepreneur Dunin-Barkovsky Daniil Dmitrievich (hereinafter referred to as the Copyright Holder), regarding the use of objects of exclusive rights.
Objects of exclusive rights
Objects of exclusive rights on the site https://uk.dunin-barkovsky.ru are:
- trademarks of Dunin-Barkovsky;
- photos and videos;
- texts;
- product and product design;
- corporate identity;
- other results of intellectual activity and means of individualization.
Exclusive trademark rights
The exclusive rights to the Dunin-Barkovsky trademarks (RF Certificate no. _) belong to the Copyright Holder. Third parties do not have the right to use these marks to personalize the services of stores and online stores, as well as the goods for which they are registered.
The use of these trademarks for commercial purposes is possible only under the terms of a license agreement concluded between the Copyright Holder and the person wishing to use his mark. The use of trademarks without a license is prohibited, including their labeling, the sale of goods using these marks, the design of websites, advertising materials and packaging.
Exclusive rights to other objects
The exclusive rights to photographs, videos, and texts belong to the Copyright Holder. Third parties may not use them for commercial purposes without the prior written permission of the Copyright Holder.
Photographs and videos may be cited for informational, scientific, educational or cultural purposes unrelated to profit-making, to the extent justified by the purpose of citation, with the obligatory indication of the protection mark "© Dunin-Barkovsky" and a dynamic link to the cited material on the website. https://uk.dunin-barkovsky.ru . When quoting, it is forbidden to make changes to the source material.
Liability for violation of rights
For violation of exclusive rights to the results of intellectual activity, civil liability is provided in the form of monetary compensation of up to 5 million rubles (Articles 1301, 1406.1, 1515 of the Civil Code of the Russian Federation).
In case of detection of the use of their intellectual property results without consent, the Copyright Holder has the right to demand the termination of the violation and compensation of up to 5 million rubles. In case of non-settlement of the dispute, the Copyright Holder has the right to apply to the court.
Unfair competition
The use of the results of intellectual activity and (or) means of individualization may be recognized as an act of unfair competition (Articles 14.5, 14.6 of Federal Law No. 135-FZ of July 26, 2006 "On Protection of Competition"). In case of such unfair use, the Copyright Holder reserves the right to apply to the antimonopoly authority and (or) to the court with a claim for recognition of the violator's actions as an act of unfair competition and recovery of losses incurred as a result of the infringer's unfair actions.
The period of validity of the notification
This notice of exclusive rights is valid for the entire duration of the existence of the Dunin-Barkovsky brand and the individual entrepreneur Dunin-Barkovsky D. D. Violation of these rights at any time entails civil liability in accordance with the legislation of the Russian Federation.
Changes to the notification
The copyright holder has the right to amend the provisions of this Notice of Exclusive Rights. The new version of the Notice of Exclusive Rights comes into force from the moment it is posted on the Internet information and telecommunication network on the website https://uk.dunin-barkovsky.ru .
